II. Special instructions for intellectual property infringement complaints
If you are an intellectual property (IP) right holder or an authorized agent filing a complaint alleging an app has infringed upon IP rights, please prepare and submit supporting materials in accordance with the requirements below. Complete materials will help us process your complaint more efficiently.
| Supporting documents | Description |
|---|---|
| Basic materials | 1. Valid ID of the right holder (for individuals) or business license (for entities). 2. If filed by an agent, a power of attorney signed or sealed by the right holder plus the agent's valid ID must be submitted. |
| Copyright | Proof of copyright ownership, e.g., copyright certificate issued by a competent authority, evidence of first publication or release date of the work, original manuscripts, creation timestamp issued by an authoritative body, or registration certificate compliant with the laws of the jurisdiction where the allegedly infringing app is distributed. |
| Trademark right | Trademark registration certificate issued by the competent trademark authority of the country/region where the allegedly infringing app is distributed. |
| Patent right | Patent certificate or registration proof. For utility model or design patents, we recommend providing an official evaluation report or equivalent legal-effect document, plus a comparison of the technical/design features. |
| Other rights | Including but not limited to well-known product-specific names, trade dress and trade secrets. Please provide corresponding legal proof based on the type of right. |
To speed up the handling process, we encourage the complainant to provide the following supplementary materials:
- Infringement comparison analysis: Detailed comparison materials explaining how the disputed app infringes IP rights, e.g., legal opinions or code/visual similarity analysis.
- Proof of right validity: Evidence proving the rights remain valid in the relevant jurisdiction, e.g., recent trademark use proof or patent annuity payment receipts.
- Official handling records: Acceptance notices, rulings, judgments, or injunctions issued by administrative or judicial authorities regarding the dispute.
III. Handling process
To protect users' legitimate rights and improve report handling efficiency, the platform has established a unified reporting acceptance and handling mechanism. The process is as follows:
1. Report submission
You may submit a report via UGREEN NAS App: APP Center > App Details > Other Information > Report, or send an email to [email protected].
- Via app: Submit the report in the APP Center of the region where the app is available. For example, if the reported app is only available in the Chinese mainland, users must switch the APP Center region to the Chinese mainland before submission.
- Via email: Users worldwide can submit reports via email.
2. Acceptance and response timeline
Reports are handled under the "5+14" reporting mechanism (5 working days for initial response, 14 working days for preliminary conclusion):
- Within 5 working days of receiving a report, we will confirm acceptance and notify the complainant of the handling progress.
- Within 14 working days of acceptance, we will complete the initial investigation and notify the complainant of the handling method or preliminary conclusion.
The above timeline is calculated in working days (excluding statutory holidays in the Chinese mainland). If the complainant is required to submit supplementary supporting materials, evidence, or complete relevant legal formalities during handling, the timeline will be paused from the date of the platform's request and resume once submission of complete and qualified materials. If the case is complex and requires an extended handling period, UGREEN will promptly explain the reason to the complainant and notify the complainant of the estimated handling timeline.
3. Verification and communication with developers
Upon accepting a report, UGREEN shall conduct a comprehensive assessment of the report in accordance with the app violation penalty rules and based on the submitted reporting materials, technical verification results, and historical records. UGREEN may issue a clarification or rectification notice to the respondent developer as appropriate, requiring the developer to submit explanatory materials or complete rectification within the specified time limit.
If the respondent developer disagrees with the handling decision, it may submit supporting materials and file an appeal in accordance with the appeal procedures. UGREEN will conduct a secondary review of the report based on the appeal reasons.
4. Notification and disclosure of handling results
UGREEN will take appropriate actions against an app based on the verification results and notify the complainant of the handling result via email. UGREEN reserves the right to disclose the app's violation details and handling results through its official channels within the scope permitted by applicable laws and regulations.
